TERMS OF SERVICE Effective Date: May 1, 2026 1. Acceptance of Terms By accessing or using soulconfluence.com, The Gem Assessment, or any related service (collectively, the “Service”) operated by Confluence Method LLC (“we,” “us,” or “our”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you must not access or use the Service. 2. Eligibility You must be at least eighteen (18) years of age to use the Service. By accessing or using the Service, you represent and warrant that you are at least eighteen (18) years old and that all personal information you provide is accurate and either belongs to you or has been provided with proper authorization. 3. The Service The Gem Assessment is an entertainment and personal-reflection tool that combines astrological calculations, numerology, and user-submitted responses to generate a personalized written dossier. The Service is provided for entertainment, self-reflection, and educational purposes only and is not intended to be relied upon as factual, predictive, or professional guidance. Additional limitations are outlined in the applicable Disclaimer. 4. Accounts Certain features of the Service may require the creation of an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use or suspected breach of security. 5. Payments Paid assessments are processed through third-party payment providers. By completing a purchase, you authorize us and our payment processor to charge your selected payment method for the full amount displayed at checkout, including any applicable taxes. All prices are listed in U.S. dollars unless otherwise stated. 6. Refunds All refund matters are governed by the Refund Policy, which is incorporated into these Terms by reference. By making a purchase, you agree to the terms of that policy. 7. License and Acceptable Use We grant you a limited, non-exclusive, non-transferable, and revocable license to access and use the Service for personal, non-commercial purposes. You agree not to misuse the Service, including but not limited to copying, reproducing, scraping, reverse engineering, reselling, redistributing, or publicly posting content without permission. You further agree not to use the Service for any unlawful, fraudulent, or harmful purpose, and not to submit false or misleading information. 8. Intellectual Property All content, software, designs, templates, branding, and materials associated with the Service, including but not limited to “Soul Confluence” and “The Gem Assessment,” are the property of Confluence Method LLC or its licensors and are protected by applicable intellectual property laws. Your personalized dossier is licensed to you for personal use only, and no ownership rights are transferred. 9. User-Submitted Information You retain ownership of the personal information you submit. By using the Service, you grant us a limited license to process, use, and analyze that information as necessary to deliver the Service, generate your dossier, and improve our systems, in accordance with our Privacy Policy. 10. Third-Party Services The Service relies on third-party providers for functionality, including but not limited to payment processing, hosting, email delivery, data processing, and automated systems. We are not responsible for the acts, omissions, or performance of any third-party service provider. 11. Disclaimers The Service is provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, whether express or implied. This includes, but is not limited to, warranties of merchantability, fitness for a particular purpose, and non-infringement. Additional disclaimers regarding medical, legal, financial, and psychological matters are incorporated separately. 12. Limitation of Liability To the maximum extent permitted by law, Confluence Method LLC and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or related to your use of the Service. Total liability for any claim shall not exceed the greater of the amount paid by you in the twelve (12) months preceding the claim or one hundred U.S. dollars (USD $100). 13. Indemnification You agree to indemnify, defend, and hold harmless Confluence Method LLC, its officers, employees, agents, and affiliates from and against any claims, damages, liabilities, losses, or expenses arising out of or related to your use or misuse of the Service or your violation of these Terms. 14. Termination We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for any reason, including suspected misuse or violation of these Terms. You may discontinue use of the Service at any time. 15. Changes to the Terms We may update or modify these Terms from time to time. Any changes will be posted with an updated effective date. Continued use of the Service after changes are posted constitutes your acceptance of the revised Terms. 16. Governing Law and Disputes These Terms shall be governed by and construed in accordance with the laws of the State of Missouri, without regard to its conflict-of-laws principles. Any disputes arising out of or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located within Missouri, except where otherwise required by applicable law. 17.
